How did the road accident happen?
Our client was travelling along a country road approaching a village when a third party pulled out of a driveway causing our client to take evasive action. Our client's vehicle rolled with extensive damage resulting in the vehicle being declared a write-off. The accident circumstances appeared straight forward with police also being in attendance. Litigation was required due to our client's significant injuries. Following litigation, arguments were put forward in an attempt to hold our client partially at fault.
What injuries did the client suffer?
Our client sustained significant life-changing injuries. Our client sustained a severe limb-threatening injury to their hand. Multiple operations were required due to the de-gloving injury. Further our client suffered psychological injury and respiratory difficulties. The injuries have altered our client's life and that of the family around them.
An argument of Contributory Negligence
A court action was required which is when an argument of contributory negligence was put forward by the defender's solicitors. Their argument was based on:
- The locus of the accident and speed limit
- Whether our client was wearing a seatbelt
- The driver window being open which in their view resulted in injuries being more severe
We successfully presented arguments for each point resulting in their being no finding of contributory negligence.
