Jennifer Murphy

Jennifer specialises in intellectual property and technology related matters with a particular focus on brand rights, IP strategy, and general commercial matters, including commercial contracts.

Jennifer has also dealt extensively with matters pertaining to the public sector, advising on commercial, regulatory, contractual, intellectual property and procurement matters, with a key understanding of the importance of her client's wider challenges and risks within this sector. Jennifer has completed a secondment with one of Scotland's largest non-departmental public bodies (Historic Environment Scotland) working closing with their legal and compliance team, providing legal support and assistance in relation to governance, compliance and regulatory issues, as well as a number of commercial contracts high profile events contracts, filming and publishing agreements, research programmes and complex commercial arrangements, litigation risks and IP strategy, particularly trade mark portfolio and brand management, licensing and commercialisation of IPR, Crown Copyright matters, and stakeholder training.

She also has extensive experience of IP auditing, particularly under the IPO funded IP audit scheme.

Within her commercial work, Jennifer focuses on complex legal agreements including website terms, end user licensing arrangements, software and app development, and consumer contracting, alongside a significant general commercial practice.  She regularly advises on complex, high value and high projects, ranging from high profile events, filming and publishing agreements, procurement of technology and software systems, research and development projects, and sponsorship agreements; to advising on engagement processes and dealing with contractual disputes.

Jennifer’s work is both contentious and non-contentious in nature. In the context of her contentious work she has dealt with a wide variety of trade mark and commercial contract disputes, including many matters which have particular reputational issues.

Jennifer advises and represents a broad client base including entrepreneurs, universities, charities associations, private and public sector bodies, covering a wide range of sectors including, food and drink, sports, technology, media, renewable energy, projects and healthcare.

Jennifer also coordinates the South Africa country desk, part of Harper Macleod's international offering.
