His focus is finding the most appropriate way of resolving his clients' disputes, which regularly involves using various forms of Alternative Dispute Resolution.
However, if a dispute requires to be taken to court, Graham has extensive experience appearing in the sheriff court around the whole of Scotland. This includes obtaining urgent protective court orders for clients in a variety of different matters. Graham also has experience of managing complex cases in the Court of Session, regularly instructing and working with Counsel.
Graham acts for clients in the protection and enforcement of their Intellectual Property rights, such as Trademark, Copyright, Patent and Design rights. He has experience in pursuing and defending court actions on behalf of clients in IP disputes in the Sheriff Court, the Commercial Court of the Sheriff Court, and the specialist Intellectual Property Court in the Court of Session. Graham is also adept at enforcing client's IP rights online.
Graham also assists clients in cross-border IP disputes. Recently, he has advised a client in respect of a Preliminary Injunction granted in the German Courts, working in collaboration with agents from Germany. Graham has contacts with a variety of IP specialist firms from around the rest of the UK and Europe.
Graham has acted for sportsmen, intermediaries, clubs and organisations in a wide variety of Sports disputes. He has represented clients in respect of matters going before disciplinary and appeal panels both at domestic and European level regarding Football, Rugby and Athletics.
Graham has experience in advising clients from both a business and a consumer perspective on their problems in the Renewable Energy sector. He has particular experience on advising clients in respect of issues relating to solar and energy saving products being sold to consumers.
Graham advises and assists employers, main contractors and subcontractors with a variety of contentious matters. He regularly represents clients in court actions in the Sheriff Court with construction related disputes. Graham is also knowledgeable in adjudication, arbitration and mediation, which allows him to tailor his advice and representation to the individual client's needs depending on the nature of the dispute.
