Graham provides advice in relation to a variety of contentious commercial and contractual disputes and problems.

Graham works with clients to resolve their issues as efficiently and cost effectively as possible. He focuses on providing tailored advice to commercial and private clients to guide them in coming to practical solutions to issues that arise.

Graham has extensive experience appearing in the sheriff court around the whole of Scotland. This includes obtaining urgent protective court orders for clients in a variety of different matters. Graham also has experience of managing complex cases in the Court of Session, regularly instructing and working with Counsel.

Graham is adept at using various forms of Alternative Dispute Resolution in order to resolve disputes for clients.

Graham also advises on the various forms of enforcement action that can be undertaken after a successful court action.

Areas of specialist knowledge

Intellectual Property

Graham acts for clients in the protection and enforcement of their Intellectual Property rights, such as Trademark, Copyright, Patent and Design rights. He has experience in pursuing and defending court actions on behalf of clients in IP disputes in the Sheriff Court, the Commercial Court of the Sheriff Court, and the specialist Intellectual Property Court in the Court of Session. Graham is also adept at enforcing clients' IP rights online.

Graham also assists clients in cross-border IP disputes. Recently, he has advised a client in respect of a Preliminary Injunction granted in the German Courts, working in collaboration with agents from Germany. Graham has contacts with a variety of IP specialist firms from around the rest of the UK and Europe.

Sports

Graham has acted for sportsmen, intermediaries, clubs and organisations in a wide variety of Sports disputes.

He has represented clients in respect of matters going before disciplinary and appeal panels, for example in respect of Football and Athletics. He has also been involved in various forms of arbitration regarding Sports disputes.

He also advises sports organisations on any issues they meet, which have not made their way into a formal court or disciplinary process, in order to avoid the matter escalating.

Fraud

Graham is a member of the firm's civil fraud team, mainly acting in cases involving the misappropriation of company funds actions.

Reputation Management and Defamation

Graham assists clients with any issues relating to reputation management or defamation. He is flexible in his approach in dealing with these matters, tailoring his advice and approach to the issues to the specific client.

Graham has assisted clients in obtaining interim orders from the court, which protect clients' often urgent issues, preserving their reputation and lively hood. He looks at each problem uniquely to identify the best tactical approach to achieving the most desirable outcome for the client.
