Amy specialises in insolvency litigation and deals predominately with actions raised in the Sheriff Court associated with personal insolvency. She has experience of raising petitions for sequestration and dealing with a range of applications in the sequestration process, including actions for reappointment of trustees and applications for consent to sell a family home. Amy regularly deals with ordinary actions for division and sale of jointly held property as well as actions for recovery of possession. She has dealt with complex actions for payment on behalf of trustees in respect of gratuitous alienations.
Amy has detailed knowledge and understanding of the Bankruptcy and Debt Advice (Scotland) Act 2014, having assisted with the development of the Act. She assisted with amending the Insolvency (Scotland) Rules 1986 which regulate administrations, liquidations and receiverships in Scotland, with the introduction of the Insolvency (Scotland) Amendment Rules 2014.
As well as insolvency litigation, Amy has experience in housing law, acting on behalf of a number of housing associations advising on all aspects of recovery of possession and child support law, acting on behalf of the DWP Child Maintenance Group in recovery of unpaid child maintenance.
