The estate administration process

When a person dies, someone has to deal with their affairs. This is called 'administering the estate’ or ‘executry administration’.

We can act as the estate administrator on behalf of the deceased and their Executor.

Responsibilities include:

  • Arranging for an independent valuation of the assets;
  • Dealing with assets outwith the United Kingdom;
  • Fulfilling the wishes expressed in the Will including contacting the named beneficiaries;
  • Liaising with HM Revenue & Customs regarding any Income Tax, Capital Gains Tax and Inheritance Tax;
  • Transferring assets to the beneficiaries.
  • Arranging for the payment of any debts (including mortgages);
  • Dealing with any claims on the estate;
  • Gathering & protecting the assets of the estate;
  • Preparing deeds of variation;
  • Settling the estate;
  • Setting up and administering trusts;

More information

How long does it take to settle an estate?

Where estates fall below the inheritance tax threshold, or are exempt from inheritance tax for some other reason, it is often possible to complete the administration of the estates within six months. Where estates are liable to inheritance tax, it can take nine months or more before the administration of the estate is complete.

Setting up & administering trusts

We also offer help in connection with trust matters. We have a great deal of experience setting up trusts for young or vulnerable beneficiaries, as well as charitable trusts and can also take care of all matters arising in connection with the ongoing administration of such trusts.

We can also help with a trust arising from an Executry, either under the deceased’s Will or under a deed of variation. Indeed, we often advise that it would be useful for executors and beneficiaries to enter into a deed of variation for tax planning or family protection reasons.
