Kelly provides advice and assistance to our public sector clients, particularly in relation to charity law, data protection, information law, corporate structures, governance, commercial contracts, compliance and regulatory issues. She regularly advises on charitable and social enterprise structures, including governance arrangements, and assists organisations in applying for charitable status.
Kelly is the principal advisor to a number of the firm’s clients in relation to data protection matters, in particular providing advice and support regarding clients’ obligations under the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018, and advising on data protection matters raised in connection with a variety of commercial arrangements.
As well as data protection, Kelly has extensive experience in advising clients on information law matters generally, in particular, the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004.
As Harper Macleod’s initial point of contact for all referrals through the sportscotland expert resource framework, Kelly works closely with sportscotland and many of the sports governing bodies, advising on a broad range of matters including data protection, charity law, commercial contracts, regulatory and compliance issues.
Kelly is regarded as a “Recommended Lawyer” in Charities & Not-for-profit by Legal 500.
