Graham is an experienced commercial litigator. He works with clients to resolve their issues as efficiently and cost-effectively as possible. He provides tailored advice to clients across a variety of areas and has extensive experience appearing in the sheriff court around the whole of Scotland as well as litigating in the Outer and Inner House of the Court of Session, and the UK Supreme Court.
Graham regularly assists clients in obtaining interim orders from the court, which protect clients’ often urgent issues, preserving their reputation and livelihood. He looks at each problem uniquely to identify the best tactical approach to achieving the most desirable outcome for the client.
Areas of specialist knowledge
Intellectual Property
Graham acts for clients in the protection and enforcement of their Intellectual Property rights, such as Trademark, Copyright, Patent and Design rights. He is adept at pursuing and defending court actions on behalf of clients in IP disputes in the Sheriff Court, the Commercial Court of the Sheriff Court, and the specialist Intellectual Property Court in the Court of Session. He regularly enforces his clients’ IP rights online. Graham also assists clients in cross-border IP disputes, working with clients and their advisers from other parts of the UK and abroad.
Sports
Graham has acted for sportsmen, intermediaries, clubs and organisations in a wide variety of sports disputes.
He has represented clients in respect of matters going before disciplinary and appeal panels, for example in respect of Football, Rugby and Athletics. He has also advocated in various forums of arbitration regarding sports disputes, including Sports Resolution, the SFA Disciplinary Panel and the European Professional Club Rugby Disciplinary Panel.
Media and Entertainment
Graham works with clients across the full spectrum of the creative industries, from artists and musicians, to organisations that provide funding and support for these industries. Regularly, the disputes that arise in this sector are focussed on concerns relating to intellectual property and routinely involve cross-border issues.
Reputation Management and Defamation
Graham assists clients with any issues relating to reputation management or defamation.
Fraud
Graham is a member of the firm’s civil fraud team, mainly acting in cases involving the misappropriation of company funds actions.
