New Civil Litigation Regulations open up damages-based arrangements (DBAs) to Scottish solicitors from today (27 April 2020). This will create more flexibility in the way that litigation is funded and allow solicitors to operate success fees on a flexible basis. The new Scottish rules differ from those currently available in England and Wales in permitting partial damages-based agreements.
