New legislation for Personal Injury in Scotland - Civil Litigation (Expenses and Group Proceedings) (Scotland) Bill
In a debate this week, members of the Scottish Parliament have given their backing to a Bill which implements recommendations made by Sheriff Principal Taylor after his review of expenses and funding of civil litigation in Scotland.
A recent case highlights the need for employers to ensure that all necessary precautions and procedures are in place to keep their employees free from harm during the course of their employment. Our specialist Accident at Work team secured an admission of fault following our client suffering a fall on ice when she was visiting a housebound patient within the course of her employment.
When our specialist Personal Injury teams are instructed by clients to pursue the recovery of damages resulting from a personal injury they have to ensure that all losses incurred are recovered. This may include sick pay paid to an employee by their employer, which then has to be repaid should they receive compensation.
A proposed new Bill attempts to make it easier and more affordable to raise a court action and to make the cost of court action more predictable. It will also enable groups of people to sue in the civil courts where they have the same or a similar claim against the same defender or defenders. Currently under Scots law such cases have to be pursued separately.
