How much does it cost to make a personal injury claim?

How long will it take to get compensation? How much compensation will I get? How much is this going to cost me? Only one of these questions can be answered with any certainty at the start of a personal injury claim. Cost. Before you even start the claim process, your solicitor will be able to tell you how much it's going to cost you.

What is no win, no fee?

There is no hidden meaning. If your claim is not successful, you don't pay anything. This kind of fee agreement is called a conditional fee agreement. Essentially, there is no upfront cost to you. If your claim is successful the fee due to your solicitor, at Harper Macleod, is a figure you agree to pay the solicitor at the start regardless of the level of compensation you receive.

With a conditional fee agreement, you are free to choose a solicitor who you feel will best represent your interests.

I have Legal Expenses Insurance

Alternatively, you might have legal expenses insurance. This kind of insurance can often be included in car and home insurance policies. If you have legal expenses insurance, in most cases, your insurer will instruct a solicitor on your behalf from its panel of approved solicitors. In some cases you have freedom of choice and can notify your insurers that you choose to appoint Harper Macleod to represent you.  If you have legal expenses insurance, you will not have to pay anything to your solicitor because your insurer will pay your solicitor's fee.

Do I need a solicitor?

Personal injury claims come in all different shapes and sizes. No two claims are ever the same because no two people are the same. Everyone reacts differently when they find themselves in a situation where they might be injured. The extent of a person's injury is as unique as they are and for this reason the value of a personal injury claim can only be determined after a thorough investigation.

A solicitor will guide you through the process of making a claim to recover compensation for the injury you have sustained and any loss you have suffered. At Harper Macleod, our personal injury team has expert knowledge and experience in dealing with all types of claims including road traffic accidents, accidents at work, medical negligence and industrial disease to name just a few.

If liability is in dispute, your solicitor will assess the strengths and weaknesses of your case and if appropriate, will instruct expert witnesses to help prove that you were not at fault. An independent medical expert will also be instructed to determine the extent of the injury you have suffered.

In some personal injury claims, a settlement will be agreed without the need to raise court proceedings. When court proceedings are needed to progress a claim, we will incur the costs associated with this and we will recover this cost from the other side.
