Frances Rooney, head of Harper Macleod's Land Registration team, has co-written the latest of a series of articles on the new land registration regime. The article, produced in conjuction with Registers of Scotland, has been published in the Journal of the Law Society of Scotland.
The article looks at advance notices, which are a new feature of property transactions in Scotland. These advance notices can be used to limit the risk of a competing deed being registered before the sale, purchase or other transaction you have been involved with.
The older method of letters of obligation is also considered, since they are technically still possible but essentially being phased out. The article considers which method should be used and when; what the benefits are; and some key points to watch out for.
