Rent reviews allow periodic adjustment of commercial rents to the current market level at the date of review. In the current climate, there has been a shift from the traditional upwards only reviews based on open market value to consideration of other alternatives.
On 28th November 2014, a large number of existing title obligations may disappear. Landowners who currently benefit from such title conditions will need to act before that date to preserve their rights.
The Crofting (Amendment) (Scotland) Bill was introduced by the Scottish Government on 9 May 2013. It aims to address issues in the Crofters (Scotland) Act 1993 ("the 1993 Act") arising from amendments made by the Crofting Reform (Scotland) Act 2010 ("the 2010 Act") which have left tenant and owner-occupier crofters not being treated equally in terms of their ability to decroft land. The Bill's intention is therefore to amend the 1993 Act to resolve difficulties that owner-occupiers currently have when attempting to decroft land.
Most people would be forgiven for thinking that a family action involving a child would be resolved relatively quickly, however, in NJDB v JEG and another, this was certainly not the case. Proceedings began in 2005. In June 2008 a proof was allowed. An eight-day proof was assigned for September 2008. The proof ran to 52 days of evidence and took over one year to complete.
