The Professional & Corporate Compliance Practice Group focuses on 3 areas within the compliance field:

Directors Duties

We can advise on what is expected of Directors and have comprehensive guidance as to their duties. With further proposed reforms to the law of 'corporate killing' and with reforms relative to Directors Duties having been introduced by the Companies Act 2006, Directors are likely to increasingly be found personally accountable in both civil and criminal law for breaches of legislation by companies, and we have advised companies in this regard. In addition we have represented clients in investigations by the D.T.I and in court proceedings raised under the Company Directors Disqualification Act 1986. The period of disqualification and can be lengthy and we will deal with these cases with the urgency they require.

Statutory Compliance

We offer advise and representation in both civil and criminal courts for breaches of all statutory offences, including offences under Companies Act, Company Director's Disqualification Act, Insolvency Act, Competition Act, Licensing Act, Financial Services Act, Road Traffic Act ,Money Laundering Regulations, Health and Safety regulations. We are experienced in obtaining favourable settlements both outwith and in Court. We have represented clients in the Sheriff court and at various Tribunals and have instructed Counsel for High Court and Court of Session action. Due to our expertise we have conducted seminars for clients on health and safety legislation, corporate killing and offer training on the new stringent money laundering regulations and offences created under the Proceeds of Crime Act.

Complaints to and investigations by regulatory and governing bodies

With the increasing powers of regulators, we are able to deal with complaints made to the regulatory body and can assist in drafting policies for procedures. We are able to advise in relation to what information has to be given over in investigations and have represented clients in hearings before their regulators including the Royal Pharmaceutical society and the Institute of chartered accountants as well as at various sporting disciplinary bodies. We can also assist in investigations commenced by, the DTI, Financial Services Authority, Competition Commission, Inland Revenue, Customs and Excise or other allegations, whether criminal or statutory offences.
